• REGISTER & TRY – Every student must register before participating in any class.
There are no charges for registering in our school. There are no charges for the first lesson in any dance style, if a new student decides to not continue.
• Fees are payable upon enrolment and at the beginning of each term.
• Enrolments are valid until the end of each school year and MUST be cancelled in written form by the end of each term when a student is unable to attend the following term.
• Families unable to make payment within this timeframe must make a payment plan arrangement with the Principals immediately.
• A late fee of $25 applies to all accounts due after 21 days.
• If a student’s fees remain outstanding at the beginning of Week 5, they will be asked to sit out of class until the full payment is received.
• All fees are inclusive of GST. Information about tuition fees are available at the member’s page.
• A tax invoice will be issued to each family one week before each term or upon enrolment.
• Fees are neither refundable nor transferable between students or terms. If a student is going to be away for extended periods of time (ie. 4 weeks or more) discounted terms fees may be applied for. These arrangements must be made at the commencement of term and discounts will be at the discretion of the Principals.

Payments will be accepted during regular school hours or office hours.
Additionally, please inform the Office Manager in writing of all address changes (street or email) or student status during the term.
The school reserves the right to remove any student who fails to comply with its rules and regulations or who engages in any activity contrary to the fulfilment of its objectives. In such an event, the school will be owed fees for the rest of the term.
Cheques returned for insufficient funds will incur a $25 fee per cheque. Contact the Office Manager

Please ensure that you have read and understood the relevant section of the terms and conditions. We cannot be held responsible for any errors caused by failure to read or understand the terms and conditions in full. As a customer of BALLET ACADEMY NORTHSIDE these terms and conditions form the basis of your agreement with BAN.
TERM FEE POLICIES
Fees for lessons are charged by the term.
• All Term fees are invoiced before the commencement of each term and MUST be paid at beginning of each term.
• If your fees continue to remain outstanding after 21 days, a administration fee of $25.00 will be automatically added to your account until it is settled.
• If you are unable to pay fees within the above period please contact us to arrange alternative payment options.
• If your child’s fees remain outstanding at the beginning of week five, they will be asked to sit out of class until the full payment is received.
• If your child’s fees continue to remain outstanding your account will be forwarded to our debt collection agency for further action. Agency collection costs will also be added onto your account.
1.1 No refunds, discounts or credits are given for missed classes for any reason. If you miss a class due to holiday or illness BALLET ACADEMY NORTHSIDE can offer a make-up class. These classes are to be arranged with BAN staff and attended within the same term as the absence.
1.2 If you don’t like the class you have chosen, you have the option to transfer to another class provided there is a vacancy and you have advised staff.

2.1 Talented and dedicated students may be invited by B.A.N. to join an Eisteddfod group, be an Eisteddfod soloist or part of a duo or trio at the discretion of the Principals.
Eisteddfod students are selected based on talent and must demonstrate commitment. They must be prepared to commit 100% to one extra class per week for their group or solo/duo/trio rehearsal before and throughout the Eisteddfod season. This also includes some rehearsals in the school holidays. Commitment to performance dates is essential for selected Eisteddfod group dancers.
2.2 Students enrolled in our school are not permitted to represent any other private dance school in competitions.
2.3 All students joining our Eisteddfod groups have a trial period of three weeks. If a student misses more than three rehearsals they may be withdrawn from participating in the group.
NOTICE BOARD POLICIES & COMMUNICATION
3.1 It is the parents’ and students’ responsibility to read relevant posted information at our website, notice board and email newsletter on a weekly basis.
3.2 BAN will communicate with you primarily by phone during our regular office times (1 p.m. – 4 p.m.) and by email if you consent to receive information from BAN via email. BAN will not provide your details to any other company, entity or organisation unless you have given consent, and all information will be kept secure by BAN in accordance with The Privacy Act.
3.3 BAN will endeavour to ensure that all communications are free of malware. It is very unlikely that you will receive any malware through us. Our system is very safe and at a very high technical standard. We cannot hold any responsible for any loss of damage suffered by you in the event that a malware or like issue is transmitted unknowingly by us or third party.
INJURY/MEDICAL CONDITION POLICIES & PROCEDURE
4.1 It is the student’s responsibility to notify their teacher in the event of injury/medical condition, prior to class.
4.2 Basic first aid is available to every student. Due to government regulations we are unable to provide anyone with Panadol or equivalent medication.
4.3 In the unlikely event of injury requiring treatment by a doctor, an ambulance will be called to the studio. Any parent opposed to this should advise this on enrolment. Every effort will be made to contact the parent if this situation arises.
5.1 Costume deposits will be required for each student if participating in any event requiring a costume (i.e. eisteddfods, public performances, end of year concert etc.). If a student fails to pay the required costume deposit, no costume will be provided.
5.2 All costumes will be provided by BAN and hired to students. The exception is solo costumes, which are the sole responsibility of the parent. All solo costumes must first be approved by BAN before performances.
6.1 Student involvement in the annual performances is encouraged, but is not compulsory.
6.2 We advise full attendance at all rehearsals for the end of year performance. BAN reserves the right to re-consider participation in performances and groups by students who miss more than three classes/ rehearsals in Term 4.
LIMIT OF LIABILITY
7.1 BALLET ACADEMY NORTHSIDE do not exclude or limit -
(a) the application of any provision of any statute (including the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of this clause 7 to be void; or
(b) direct losses and damages which arise only as a result of BAN’s gross negligence (which means where BAN commits an act or allows an omission to occur in reckless disregard the consequences of the act or omission).
7.2 Except where clause 7.1 applies, BAN excludes all statutory liability, tortious liability (including but not limited to liability in negligence), the general law or statute, liability for all direct, economic, consequential or indirect losses, expenses, damages and costs incurred by you, arising out of or relating to the attendance at class, including, but not limited to, liability for gross negligence and except to the extent of clause 7.1(a), BAN is not responsible or liable for any indirect consequential or economic damages.
8.1 Dance is a physical activity and the teacher or teaching assistant may have to assist your child’s understanding of an action, posture or position by physical contact e.g. holding hands in a circle; lifting, correcting posture. You consent to employees, sub-contractors, contractors and directors of BAN having contact with your child in this regard.
8.2 Should your child hurt him/herself, you consent to employees, sub-contractors, contractors and directors of BAN to attend to your child whilst BAN wait for the nominated guardian to take over.
8.3 Your child’s enrolment into a BAN class is voluntary and participation in the class and the activities of ballet, creative movement and dance involve numerous risks of injury, including but not limited to muscle strains, sprains and falls and you are aware these are risks for your child as outlined in clause 7.
8.4. You must inform BAN and all teaching staff of any injuries, medical conditions and allergies suffered by your child.
CLASS ATTIRE POLICIES
9.1 All students must be appropriately dressed for class in correct studio uniform and correct footwear.
9.2 All students must be appropriately groomed for class, with their hair tied back securely. Female students must have their hair in a bun with hair net and pins for every ballet class. Female students with short hair must secure it with a soft headband. Male students should have their hair off their face.
9.3 Any student dressed or groomed inappropriately will be asked to improve their appearance when next attending.
10.1 Prior to photographing and/ or videoing any class please seek permission from the teachers and the other family members in the class.
10.2 Any recording or photography is for personal use only and not be for commercial sale.
10.3 Any recording or photography is not to be uploaded onto the internet, social networks &/or video/photo sharing sites.
10.4 All choreography works are the intellectual property of Ballet Academy Northside. It is an infringement of copyright to reproduce, communicate, publish or perform all or a “substantial part” of a piece of choreography, unless the copyright owner has given permission or certain exceptions apply. Choreography copyrights including individual created solo’s, duet’s, group dances and “substantial” movement sequences, it also includes stage design, costume design, light design and all ideas of story and concept.
11.1 Grant of Rights. Upon enrolling my child into a class at BALLET ACADEMY NORTHSIDE, I hereby grant to BAN the absolute and irrevocable right and permission, throughout the world, in respect of the photographs and/or video footage (“the material”) that it has, has taken, or has had taken of my child or in which my child may be included with others: To use, re-use, publish, and re-publish, and otherwise reproduce, digitise, edit, modify, distribute in print and online, publicly display in print and online, share via social media, and publicly perform the same, in whole or in part, individually or in conjunction with other photographs or videos, and in conjunction with any copyrighted matter, in any and all media now or hereafter known, for illustration, website, promotion, art, marketing, advertising and trade.
11.2 Release. Upon enrolling my child into a class at BAN, I hereby release and discharge BAN from any and all claims and demands arising out of or in connection with the use of the photographs or footage, including without limitation any and all claims for defamation, invasion of privacy, and misappropriation of my right of publicity. I hereby by waive any claim that I may have to inspect or approve any images, products or copy in connection with any of the material.
11.3 Copyright in the Material. Upon enrolling my child into a class, I acknowledge that I have no claim to the copyrights in the material. The copyright owners have the right to copyright the material in their own names or otherwise and to use, assign, and license the material throughout the world, including any rights I might have.
11.4 Representations. I have read the foregoing and fully understand the contents thereof section
This release shall be binding upon me and my heirs, legal representatives and assigns. I further release BAN from any responsibility for injury incurred during any and all past, present or futures photography and/or video sessions and activities.
12.1 Students are expected to follow the code of conduct and be cooperative at all times. Warnings will be given for disruptive behaviour, and parents will be notified. Our objective is that every student feels valued and enjoys their dance experience.
13.1 Parents with children under 10 years of age should supervise their children before class. We are only responsible for your children in the dance studio.
13.2 Students are expected to be collected from the studio by their parents before the commencement of the next class. If there is an unavoidable delay, students are expected to stay within the premises.
Enrolment in any class or private session constitutes agreement to a waiver of liability for injuries or illness contracted while a student is at the Studio:
CLIENTS ASSUMES FULL RESPONSIBILITY FOR ANY AND ALL DAMAGES, INJURIES (INCLUDING DEATH) OR LOSSES THAT HE/SHE MAY SUSTAIN OR INCUR, IF ANY, WHILE ATTENDING, PRACTICING, PARTICIPATING IN, OR WITNESSING ANY CLASS OR PRIVATE SESSION PART OF THE DANCE & PILATES PROGRAM , OR PHYSICAL ACTIVITY OCCURRING IN OR ABOUT BALLET ACADEMY NORTHSIDE (BAN) PREMISES. CLIENTS ASSUMES FULL RISK, WAIVES ALL CLAIMS AND RELEASE AND HOLD BALLET ACADEMY NORTHSIDE, ITS INSTRUCTORS, OR PARTNERS OF SAID PROGRAM, INDIVIDUALLY OR OTHERWISE HARMLESS FOR ANY AND ALL CLAIMS FOR INJURIES OR DAMAGES.
In consideration of (CLIENTS) participation in and the use of BAN’s facilities, he/she hereby releases and covenants not to sue BAN, its owners, directors, offices, employees, representatives, agents, trustees and lessees from any and all present claims resulting from ordinary negligence and inherent risk of use of facilities and equipment of BAN including but not limited to any loss, injury, damage or liability sustained by him/her while on or about the premises of Ballet Academy Northside.
